Greetings in the 70th year of the Hotel & Restaurant Association Western India!


I am sure you are aware, that The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (“Act”) is a legislative Act in India that seeks to protect Women from Sexual Harassment at their place of work. In the current scenario and more so, in light of the recent #MeToo Movement, improving literacy on this law is a long-term behavioural change initiative. It requires a multi-faceted approach and sustained action over time, to bring about gradual improvement which is of utmost importance for the hospitality industry.  


The said act also widely known as Prevention of Sexual Harassment (PoSH) Law, stipulates that a woman shall not be subjected to Sexual Harassment at any Workplace. As per the statute, presence or occurrence of circumstances of implied or explicit promise of preferential treatment in employment; threat of detrimental treatment in employment; threat about present or future employment; interference with work or creating an intimidating or offensive or hostile work environment; or humiliating treatment likely to affect the lady employee's health or safety may amount to Sexual Harassment.


The Act mandates certain legal requirements and processes that need to be put in place for all Hotels& Restaurants to provide a safe working environment for women.


We are pleased to inform you, that your Association is organizing a Seminar on “Awareness of Sexual Harassment of Women at Workplace". The program is scheduled to be held on:

We have invited Mr. Vishal Kedia, Founder & Director of Complykaro Services Pvt. Ltd., who isa subject matter expert and an eminent trainer on PoSH Law having conducted training sessions for more than 35,000 ICC members as well as hundreds of employee awareness sessions across India. Mr. Kedia has been a Keynote Speaker at numerousSeminars & Conferences on PoSH Law organised by various associations across India. You will be pleased to know that he was also, the Keynote Speaker for few of the PoSH Seminars conducted by HRAWI in the past as well.Complykaro has been empanelled by Ministry of Women & Child Development, Government of India, as a resource company for providing PoSH Training to organisations and has also won several awards & accolades for its exemplary work over the years.


The said awareness program will cover the following broad topics: 

  • Awareness amongst attendees about the requirements under law.
  • Misconception with regards to the law.
  • Important definitions including sexual harassment explained with several examples.
  • Salient features of the law which are beneficial for the complainant, respondent & organisation at large.
  • How do you identify sexual harassment: Quid Pro Quo, Unwelcome, Intent Vs. Impact & Hostile Work Environment.
  • Rights of aggrieved women including redressal options and procedures.
  • Corresponding rights of respondent including redressal options and procedures.
  • Specific points to remember for employers.
  • Lessons learnt by corporates till date.
  • Q & A

It is recommended that Hotel Owners, Senior Management, HR Heads and Members of the Internal Complaints Committee attend this Training Programme as it will help clarify the salient features and requirements of the law. 


Consequences of non-compliance:


Any non-compliance with the provisions of the Act or Rules is a criminal offence for the Management and could lead to penalty of upto INR 50,000 for the first offence and double the penalty and cancellation of business license for subsequent violation.   This is apart from other legal consequences for the organization.


You are aware that, the The Law on this very subject, fits well with the pledge of commitment towards "Code of Conduct for Safe and Honourable Tourism" signed by every hotel, whilst obtaining recognition / renewal as a classified Hotel from Ministry of Tourism, Government of India. Hence, we are keen to create similar awareness about the law amongst all HRAWI members.


It was always evident after the Seminar on this subject, the delegates felt that compliance with the said law would make female Tourists / Employees feel safer in India and fits ideally in the concept of “Atithi Devo Bhava”.
